The Texas State Board of Pharmacy
The Texas Legislature passed the first Texas Pharmacy Act in 1907, and in doing so, established the Texas State Board of Pharmacy as an independent state regulatory board. The Pharmacy Board is responsible for the licensure and discipline of pharmacies, pharmacists, and pharmacy technicians in Texas. The Pharmacy Board is located in the William P. Hobby Building, Tower 3, Suite 600, 333 Guadalupe, Austin, Texas.
The mission of the Pharmacy Board is to promote, preserve, and protect the public health, safety, and welfare by bolstering the provision of quality pharmaceutical care to the citizens of Texas through the regulation of the practice of pharmacy, the operation of pharmacies, and the distribution of prescription drugs in the public interest.
The Pharmacy Board meets on a quarterly basis in Austin Texas, and is comprised of nine (9) members. These members are appointed by the Governor for six (6) year terms, which overlap. Six (6) of these members must be licensed pharmacists who are in active practice. In addition, there are approximately fifty full time employees.
In 2007, there were approximately 6,229 pharmacies, approximately 23,429 pharmacists, and 30,091 pharmacy technicians licensed in the State of Texas. Over the past few years, the Pharmacy Board has consistently received over 3,000 complaints against pharmacies and pharmacists. Last year, the Pharmacy Board issued over 1,000 Warning Notices to pharmacies, and entered over 400 disciplinary actions against licensed pharmacists and pharmacy technicians.
Upon receipt of a complaint, the Pharmacy Board verifies that the subject of the complaint is a licensee of that agency. In addition the complaint is reviewed to determine whether the actions the subject of the complaint, if true, would constitute a violation of the Pharmacy Act. Once this determination is made, an investigation is initiated. Upon completion of this investigation, the matter is either closed because there is no violation of the Pharmacy Act, or it is referred for an informal hearing referred to as an Informal Settlement Conference / Show Compliance Proceeding. The majority of complaints are resolved during this process either by being dismissed as no violation, or resolved through an agreed disposition. If the licensee and the Pharmacy Board are not able to reach a resolution of the complaint, then the matter is referred to the State Office of Administrative Hearings for a formal hearing, and final resolution.
